A Nairobi father has issued a legal demand dated October 2, 2026, to an official attached to the Nairobi City County Assembly, demanding that she immediately end an inappropriate romantic relationship with his son. As reported by uzalendogram on Instagram, the notice accuses the official of enticing the student into abandoning his university education.
The legal notice, drafted by Mwendwa Mwinzi & Associates Advocates on behalf of Mr Harrison, sets a strict seven-day ultimatum for the county official to give a written undertaking that she will cease hosting the student at her Donholm residence and stop interfering with his studies.
Admission to university and sudden departure
According to the demand letter, the client’s son was admitted to Kabarak University in September 2025 to pursue a Bachelor of Commerce degree, with all requisite university fees fully paid by his father to facilitate his higher education.
However, shortly after his admission to the institution, the official reportedly took the young man to her residence in Donholm Estate, Nairobi. The legal document asserts that she has since been keeping and engaging him in an inappropriate romantic relationship, leading to the student abandoning his university studies despite the tuition having been settled.
Legal grounds and constitutional violations cited
In the formal notice, the law firm highlighted several constitutional and statutory provisions that the county official has allegedly violated by harbouring the student and encouraging his academic abandonment:
- Article 43 (1) (f) of the Constitution: Entitles every person to the right to education, establishing that the student has a right to pursue his future without external manipulation, inducement, or improper influence.
- Article 53 of the Constitution: Guarantees protection from conduct prejudicial to welfare, placing paramount importance on the development and education of young persons.
- Section 35 of the Children Act, 2022: Provides for the extension of parental responsibility beyond an individual’s eighteenth birthday where special circumstances concerning their welfare necessitate judicial intervention.
The legal counsel noted that the parent is prepared to invoke the jurisdiction of the court under Section 35 of the Children Act to place before the judiciary the full circumstances surrounding his son’s abandonment of higher learning.
Threat of workplace reporting and legal proceedings
The law firm warned that should the official fail to comply with the cease-and-desist demand within seven days, the matter will be formally escalated to her employer, the Nairobi City County Assembly. The complaint would cite immoral, unethical, and unbecoming conduct that falls short of the core values and principles governing public service in Kenya.
Failure to submit a written undertaking within the stipulated timeline will also trigger immediate court proceedings against the official without further notice.
